Implementation of criminal fines for violations of the sale and provision of alcoholic beverages, Lima Puluh Kota Regency Regional Regulation

The Government of Lima Puluh Kota Regency enacted Regional Regulation Number 3 of 2017 concerning Public Order and Public Tranquility, which regulates, among other matters, the control of alcoholic beverages as stipulated in Article 28. One violation of this regulation occurred in Lima Puluh Kota Regency and was adjudicated in the Tanjung Pati District Court Decision Number 1/Pid.C/2022/PN Tjp, in which the defendant was sentenced to a criminal fine for selling and providing alcoholic beverages in violation of the regulation.
This study aims to examine two main issues: first, the application of criminal fines to perpetrators of selling and providing alcoholic beverages in violation of Lima Puluh Kota Regency Regional Regulation Number 3 of 2017 as reflected in Decision Number 1/Pid.C/2022/PN Tjp; and second, the considerations used by judges in imposing such fines. The research is descriptive in nature and employs a normative juridical approach. The data used are secondary data obtained through document study, which are analyzed qualitatively.
The results of the study indicate that the defendant was sentenced to a fine of IDR 300,000.00 (three hundred thousand rupiah), with a subsidiary punishment of seven days’ imprisonment if the fine is not paid. However, this sanction is considered too lenient and insufficient to create a deterrent effect. Light criminal sanctions tend to reduce the effectiveness of law enforcement and may fail to prevent offenders from repeating similar violations after returning to society. Therefore, judges are expected to impose stricter and heavier sanctions to ensure legal certainty, justice, and deterrence.
The judge’s considerations in imposing the fine consisted of both legal and non-legal aspects. The legal considerations were based on the fulfillment of the elements contained in Article 28 paragraphs (1) and (2) in conjunction with Article 48 of Regional Regulation Number 3 of 2017. Meanwhile, the non-legal considerations included the fact that the defendant had never been previously convicted, expressed remorse, and promised not to repeat the offense.
